Terms and Conditions

General

These terms and conditions govern the supply of goods sold by The Home Security Shop (A Division of Panoramic Fire and Security Ltd) to the customer (you).  

a) Please read these Conditions carefully and make sure that you understand them, before ordering any Goods from our site. Please note that before placing an order you will be asked to agree to these Conditions. If you refuse to accept these Conditions, you will not be able to order any Goods from our site.  We draw your particular attention to your rights of return and cancellation in clause 7 & 8 and the limits to our liability in clause 9. 

b) We reserve the right to amend these Conditions from time to time. Every time you wish to order Goods, please check these Conditions to ensure you understand the terms which will apply at that time.

c) All orders placed by you for the purchase of goods from our website or via the telephone are on the basis of these Terms and Conditions.  Our website will guide you through the ordering process and will give you several opportunities to check and amend any errors prior to submitting your order.  Please ensure you check your order at each stage of the order process.

d) Orders placed through our website or over the telephone are not deemed to have been accepted by us until such time as we have processed the order through our system and have sent you a dispatch confirmation note.                                     

e) The processing of your payment and acknowledgement of your order does not constitute our acceptance of your order.

f) If any provision of these Terms and Conditions (including any provision in which we exclude or limit our liability to you) is found to be invalid, illegal or unenforceable, the validity, legality or enforceability of the other provisions of these Terms and Conditions and the remainder of the provision in question shall not be affected. Our contract shall be governed by and interpreted in accordance with English law. 

g) All images on the Home Security Shop are for illustrative purposes only.  We have taken great care to ensure they are correct and accurately represent the item for sale, however mistakes may from time to time happen and if you are not entirely satisfied with the goods you receive you may return them under our 14 day guarantee.

h) You may only purchase goods from our site if you are 18 years and older

 

Ordering

Our website will guide you through the ordering process and will give you several opportunities to check and amend any errors prior to submitting your order.  Please ensure you check your order at each stage of the order process.

a) All orders placed by you are subject to acceptance by us.  We may choose not to accept your order or purchase for any reason and will not be liable to you or to anyone else in those circumstances. Please ensure that you do not book any 3rd parties (e.g. electricians) before you physically take delivery of your order – The Home Security Shop will not be held responsible for any 3rd party related costs.

b) Where we accept your order, we have a legal duty to supply goods that are in conformity with these Terms and Conditions.

 

Price & Payment

The price payable for the goods you order or purchase is as set out on our website at the time you submit your order.  All prices include the current applicable VAT rate and are in GBP Pounds Sterling.

a) Whilst we take every effort to ensure pricing and product descriptions are correct on our web site from time to time errors may occur, in which case we reserve the right not to supply the goods in question, and to correct any errors from time to time.  In such a situation we will make every reasonable effort to contact you for confirmation that you wish to continue with the order at the correct price or description, or cancel your order and advise you of the cancellation.

b) All prices are fixed at the date of the contract and will only subsequently be varied by agreement in writing by both the buyer and the seller.

c) We must receive payment for the whole of the price of the goods you order and purchase, and any applicable charges for delivery, before your order can be processed unless we have agreed otherwise in advance in writing.

d) Payment on our website can be made by most major credit or debit cards/Klarna and PayPal.

e) By using a credit/debit card to pay for your order you confirm that the card being used is yours or you are authorised to use it.  By using PayPal or Klarna you confirm that the account being used is yours.

f) All credit/debit card holders are subject to validation checks and authorisation by the card issuer. All PayPal and Klarna payments are subject to authorisation by PayPal/Klarna. If the issuer of the card Klarna or PayPal refuses to authorise payment we will not accept your order or purchase, we will not be obliged to inform you of the reason for the refusal, and we will not be liable for the item not being delivered or provided to you. We are not responsible for the card issuer or bank charging the holder of the card as a result of our processing of your credit/debit card payment in accordance with your order or purchase or if PayPal/Klarna charges you for making the order.

g) Subject to clause 9, we cannot be responsible for any losses you may incur in transmitting information to us by internet link or by email. Any such loss shall be entirely your responsibility.

 

Delivery & Title

a) Delivery, packing and handling charges are displayed on our website.  These are subject to change by us at any time; we will notify you of any changes prior to delivery and obtain confirmation from you that you wish to proceed with the order.

b) We aim to delivery within the quoted time frame – but delivery dates quoted are approximate and we will not be liable for any delays how so ever they occur.  We reserve the right to deliver an order in instalments by separate delivery shipments.

c) Delivery will be made not more than 30 days after the day you place your order, unless otherwise agreed between us, subject always to clause 5 and 11.

d) Deliveries will be made between 8.30am and 6.00pm on any working day (Monday to Friday) excluding bank holidays. 

e) Before placing your order please refer to the delivery options set out on our website to ensure we are able to deliver to your address.

f) Delivery of the goods will have been deemed to have taken place when they have been delivered to the delivery destination and a signature on behalf of you has been received in respect of the goods.

g) In the unlikely event that you have not received all the goods within the stated delivery time, you must notify us immediately. We strongly suggest that you do not schedule or commence any installation work until after you have received your order and checked all the goods are suitable for your purposes and do not have any defects or missing parts.

h) You must do all that you reasonably can to enable delivery to take place at the given time and place. If you delay delivery, or delivery fails because you have not taken appropriate steps, we will try to arrange for an alternative delivery date as soon as possible after the original delivery date and within 30 days of the failed delivery. 

i)  If delivery fails as a result of circumstances within your reasonable control, the cost of any re-delivery shall be borne by you. If we are unable to arrange a date for re-delivery we reserve the right to cancel your order and refund to you the price that you have paid for the goods, less the failed delivery costs.

j)  Once the goods have been delivered to you the goods will be at your risk and responsibility. 

k) We accept no responsibility for loss, damage or shortages which may occur to the goods after the risk has been passed to you.  In the event that a claim arises in respect of any loss, damage or shortage arising during transit then you must notify us within 48 hours of receipt of the goods and agree to comply in full with the carrier’s standard conditions for claims for damage, shortage or loss in transit.

l) In spite of delivery, ownership (title) of the goods does not pass to you until we have received full payment for the price of the goods.  Until such time you shall not be entitled to use the goods, must safely hold the goods for us, return the goods to us immediately if we ask you to and be liable to us for any loss, damage or the destruction of the goods.

m) Until title in the goods passes from us to you, you shall store the goods at your own cost separately from all other goods in your possession and marked in such a way that they are clearly identified as our property. You grant us an irrevocable licence to enter, with or without vehicles, any of your premises for the purpose of inspecting or repossessing the goods.

 

Availability

a) All goods are subject to availability. If we have insufficient stock to supply the goods ordered, we will attempt to contact you to ask you how you wish to proceed by offering a suitable alternative or make partial shipment of the remainder of the goods you ordered.  You are under no obligation to accept either of these alternatives and may cancel the entire order, and any monies paid by you will be refunded.  If we are unable to contact you, we may, at our discretion, process any part of the order which is available.

b) We will not be held liable for any costs incurred by you for the booking of an installation contractor where a delay in the delivery of products occurs or where there is a problem with the delivered items.  We strongly advise that you do not book a contractor until the goods have been received and checked.

 

Manufacturer's Warranties & Guarantees

a) Some of our goods are sold with a manufacturer's warranty, guarantee or similar assurance. Any complaint, query or claim under a manufacturer's warranty, guarantee or similar assurance must be made direct to the manufacturer and we do not have any responsibility or liability under or in connection with any such warranty, guarantee or assurance.

b) For items that are subject to extended manufacturer warrantees it is up to you to ensure you comply with the manufacturer warranty terms, including registering the product with the manufacturer if applicable.

 

Cancellation, Returns & Refunds

a) You may cancel your order and return the items purchased to us by giving us notice of cancellation within 14 days of the date of delivery to you. 

b) If your order comprises of multiple delivery shipments, the 14 day cancellation period will run from the date of delivery of the last shipment to you.

c) If you decide to cancel the order, for whatever reason, where you have received the goods you must return them to us (together with the original packing) without undue delay and in any event within 14 days after you have notified us that you wish to cancel, at your costs.

d) You must return the goods in an un-used state and in the original undamaged packaging with seals intact and with the entire component parts and any promotional items received or discounted additional products.  If products are not returned in a satisfactory condition, including damage caused due to insufficient packaging for the return transition to us, we may return the goods to you and not issue a refund or reduce your refund accordingly to take into account the reduction in value of the product.

e) Following receipt of the returned items we will refund you the price paid for the returned goods.  Where items have been returned because they were incorrect, faulty or damaged and where you have returned the entire order, we will also refund you the standard delivery charges, if applicable.

f) We aim to make refunds for cancelled orders within 5 days of receipt of the items back into our warehouse.  Please note that in exceptional circumstances a refund may take up to 14 days.

g) Refunds will be made to you using the same means of payment as you used when placing your order with us.

h) We reserve the right to make a deduction from the amount of the refund for loss in value of the goods returned where the goods show signs of unreasonable use; for these purposes, unreasonable use includes handling the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.  Or, in exceptional circumstances, return the goods to you and not make any refund.

 

Faulty Goods

a) Where you wish to return goods because you believe they are faulty please follow our Returns Policy & Procedure.

b) The Home Security Shop will meet the cost of the return of the goods.

c) All items must be packaged in a manner suitable for safe transportation and returned to us in a satisfactory condition where on a case-by-case inspection a returns refund may be given.

d) In an instance where returned items are further damaged in transit due to insufficient or inadequate packaging, we reserve the right to reduce any credit due, not to make refund or replacement of said damaged goods.

e) If you notify us of your items being faulty within 30 days of receipt of the items you may choose if you wish the goods to replaced, repaired or ask for a full refund (on receipt of the said goods back in our warehouse).

f) If a fault develops after 30 days after the date of delivery (but before 6 months) we may either repair the goods to replace them with identical (or if not available an equivalent model) or at our discretion, make a full refund. Claims for faults identified outside of this period will need to be made as per the Manufacturers warranty, directly to the manufacturer concerned.

 

Liability

a) If we fail to comply with these terms and conditions we are responsible for loss or damage you as a consumer suffer that is a foreseeable result of our breach of these conditions or our negligence.

b) However, we are not liable for, to the extent not prohibited in law:

  • Loss which is not foreseeable (loss is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time you and we entered into our contract)
  • Loss which arises when we are not at fault or in breach of these Terms and Conditions
  • Business loss (which includes loss of profits, loss of business, contracts, goodwill, business opportunity and other similar losses, as well as business interruption)

c) Nothing in these Terms and Conditions is intended to affect your legal rights if you are not a consumer, nor is it intended to exclude or limit our liability to you for fraud, fraudulent misrepresentation, for death or personal injury resulting from our negligence or for any other liability which cannot be limited or excluded as a matter of applicable law.

d) Goods are intended for private and domestic use only and within the UK.  We cannot confirm that the goods comply with any laws, regulations or other standards applicable outside the UK, and are unable to accept liability for goods being taken or used outside of the UK. All goods are sold in accordance with the manufacturer’s specifications and are subject to any qualifications, representations or instructions contained in the documentation associated with the goods.

 

Termination

a) The Home Security Shop reserves the right to cancel any orders, and for whatever reason, prior to delivery of the goods to you.

b) In such a situation we will notify you in writing of our decision to cancel.

c) You have the right to cancel any order placed with The Home Security Shop prior to delivery and up to 14 days after you receive receipt of the goods – for whatever reason.  Please view our returns policy for further details on how to return an item.

 

Events Beyond Our Control

a) We will not be liable or responsible for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder or for any other liability, in each case that is caused by any event or circumstance beyond our reasonable control.

b) Events beyond our control includes, but are not limited to:  accidents, extreme weather conditions, fire, explosion, flood, storm, earthquake, natural disaster, failure of telecommunications networks, inability to use transport networks, mechanical failures, acts of God, terrorist attack, war, civil commotion, riots, strikes, lockouts and other industrial disputes, acts or restraints of Government, and imposition or restrictions of imports or exports.

c) In such an instance we will notify you of the change in circumstances as soon as is practicably possible, with a revised delivery date or may offer items of a comparable nature.  You may at this time choose to continue with the contract or cancel it by contacting our customer services team.  If you decide to cancel you will need to return any relevant goods you have received linked to the cancelled item (e.g. promotional items), or items that have been purchased for use with the product in question.  Collection will be arranged at our cost.
